I. Scope of this Privacy Policy

This Privacy Policy describes how John Harris Gesellschaft m.b.H. and its subsidiaries (John Harris Margaretenbad GmbH, John Harris Wien GmbH, John Harris Graz GmbH, John Harris Linz GmbH) (in short "JHF") use those personal data that are collected in the course of a new membership, a transfer of a membership and a change of membership data by JHF and from interested parties (by contract). Furthermore, it describes how data is handled and recorded in the course of image processing as well as the collection, processing and use of personal data in connection with digital services.

II. Use of the Membership Data Provided

JHF attaches great importance to the confidentiality and protection of personal data, membership data, as well as data of interested parties.

This membership data includes:

Salutation, first and last name, academic degree, photo of the member, home address, telephone number, e-mail address
Type of membership, start and end date of membership, minimum contract period, fees, additional packages booked
Proof of identification (identity card, driver's license, passport, student ID, company ID, etc.)
General bank data for the execution of issued direct debit orders
Customer service data, such as telephone calls made (summarized in writing, no records or recordings), internal membership communications, record of access data, documents / correspondence received and issued
Regarding prospect data:

JHF uses member data exclusively for the following purposes:

All membership data will be stored for the duration of membership and beyond to the extent required by law.

IV. Data Security

JHF endeavors to ensure smooth operation and to comply with a variety of data security mechanisms to safeguard the confidentiality and integrity of the personal data transmitted. All data is stored exclusively on servers in the European Union.

V. Data subject rights

The member or interested party is of course entitled to information about his stored data at any time, provided that this data can be directly attributed to the member or interested party. If the data is exclusively anonymous - i.e., data that can no longer be assigned to the customer (this is the case if identification is not (or no longer) possible) - information can no longer be provided by JHF. The data subject has the right to request JHF to correct any inaccurate personal data relating to him or her without undue delay. Taking into account the purposes of the processing, the data subject has the right to request the completion of incomplete personal data - also by means of a supplementary declaration.

For the exercise of the data subject rights, an official photo ID must be presented. In principle, such information is free of charge. However, JHF reserves the right to charge an appropriate fee for the administrative effort involved in providing information that exceeds the scope of the information required under the DSGVO as amended. Complaints against the processing of personal data by JHF may be lodged with the data protection authority at the following address; Wickenburggasse 8, 1080 Vienna.

VI. Image Processing

Certain Club areas - inside as well as partly outside - are monitored by means of video recordings, exclusively for the purpose of property protection and law enforcement, in the legitimate interest. In the course of these recordings, it is not excluded that persons concerned are recorded. The storage period of the recordings is 72 hours. If the end of the period for deletion falls on a Saturday, Sunday, public holiday, Good Friday or December 24, the next day that is not one of the aforementioned days shall be the last day of the period for deletion.

Image processing is generally limited to the entrance and exit areas of the club, partial outdoor areas (e.g. facade and glass surfaces), as well as areas with increased potential for danger (e.g. free weights and weight area, swimming pool), increased traffic (e.g. access to checkrooms) or safety-critical locations (e.g. access to EDP systems) exclusively for the purpose of property protection and law enforcement. No image or sound data is collected in the checkroom or nude areas. JHF ensures, with the help of processing protocols and special mechanical and technical access mechanisms, that only authorized persons have access to recorded video material and can evaluate it, even if only for cause. All clubs where image processing is used are marked accordingly at the entrances.

In order to make the JHF websites user-friendly and to enable the use of certain functions, we use so-called cookies. These are small text files that are stored on your terminal device. However, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. In some cases, we use social media plugins to share certain content on social networks. URLs are transferred when clicking on these external links. What data is processed is not within our control and can be found in the privacy statements of the respective social networks. In our blog, members will find out about the latest fitness trends and other fitness-related stories at regular intervals. The content is partly contributed by external editors ("bloggers") in addition to JHF. Journalistic opinions and statements of external bloggers do not always have to correspond to the opinion of JHF.
